Making the Fresh Start Presentation

So you are out and running your route and have found a homeowner home who wants to listen to a Fresh Start Presentation (FSP). Remember the Fresh Start Presentation is the Homeowner Options slide show that you have. It goes through the advantages and disadvantages of the seven (7) options available to the financially distressed homeowner. They are as follows:
1)Sell on the Open Market
2)Refinance the home
3)Restructure the mortgage
4)File bankruptcy
5)Borrow from friends and family
6)Let it go to foreclosure
7)Sell to an investor

Whether you have scheduled an appointment or have just knocked the door the opportunity to make the presentation will lead to money for you. So what is the best way to make the presentation? Do you start with the overview and then go through each option? Do you ask some preliminary questions and get to the homeowners present position or do you just get to the price we will pay for the home and leave it at that?

The answer depends upon the homeowner and your preparation for your visit with the homeowner. Remember ?Information is power and the key to a successful negotiation and purchase of your next home or investment property?. So if you have failed to prepare for your meeting with the homeowner your chances of success are diminished. We try to gather information for you and put it in the notes. Some information can be gathered by going over the pricing of the home when you have a scheduled appointment. The rest of the information will come from the homeowners? needs and wants and honest eyes.

What follows are typical situations you will run into in the field and what assumptions you should make if you run into these types of situations. They are 1) Research indicates that the home is on the market. 2) Home is vacant; 3) Homeowner just came out of Bankruptcy.

Home on the Market

What assumptions can we make if the home is placed on the market?
1) We know that they are willing to leave the home and move on with their lives.

2) The Homeowners have cut the emotional attachment to the home.
3) They have either eliminated or exhausted the following options: refinance, restructure and borrowing from friends and relatives.
From this we can make the following conclusion: The homeowner is left with the bankruptcy option and selling on the open market or to us. Here is a note from a locator regarding a house that is on the market.

Visited 8/12/06; 1PM. Met HO in driveway. HO's are divorced and selling the property. Home vacant. Property is listed with Briarwood Realty. Presented the Fresh Start Program to HO's. Interior of the home is broom swept condition already. Good condition. Husband was ready to give release, wife not willing to give release today. Wife indicated that she would like to take a few days and to talk with the bank on Monday. We agreed to contact each other on Tuesday 8/15/06. I left contact info with them and received their contact info as well. Will take complete set of photos when I get the release. Both HO's confirm that they have equity in the property.

Now what part of the FSP would you pitch to get the release? How do you begin the process? If I knew the number they had placed on the house, I would talk about market time, home inspections and the possibility of an unsavory investor tying them up until it is too late and purchasing at the auction.

If I did not know the market number I would ask for the price and how long it has been sitting on the market.

This type of presentation should begin with a back-up plan or safety net plan. It should inform the homeowners that we could possibly purchase the property in a quick fashion and net them some money for their fresh start. We would do this by making a deal with the listing broker to continue to list the property after we purchased it. Saving the homeowners the cost of the broker. We could also inform them that they would not have the carrying costs, insurance, taxes, and foreclosure costs that are currently stacking up on the property. All of this may add up to a less stressful conveyance than waiting out a slow market. When a home is on the market it is fairly difficult to get a homeowner to agree to sell the property to an investor. Reasons are that some mortgage broker has told them that they can sell their home for a number we will not pay. Only time and an auction date will usually make this homeowner come around. A smart locator will make the pitch for the backup plan and wait until it is close to the auction to return for a final opportunity to purchase the property. In the meantime just call the homeowner every week or ten days to check in on their situation. This will allow you to have a continuing dialogue and build some type of relationship with the homeowner.

HOME IS VACANT

What assumptions can we make if the home is vacant?

1) We know that they are willing to leave the home and move on with their lives (they already have).
2) The Homeowners have cut the emotional attachment to the home.
3) That the house is costing the homeowner carrying costs each and every day. We can stop the bleeding by purchasing the home.
4) Homeowner should be happy to unload the property.

Here is a note of a recent vacant home visit:

Visited 8/12/06; 3:15PM. HO not home. Left into letter in the door with personal note. Spoke with the neighbor to get an update on this property. Mailbox is full. Shrubs and vines have overgrown the yard and cover the primary entrance to the house. Lawn has not been mowed in months. Neighbor says that the owner is a great person. He seems to think that the owner has another residence in Marshfield. This property had been up for sale. The HO has been trying to sell it for almost 2 years. He believes that the last listing was $249K. He also has been in the house and said that a lot of work has been done on the inside. Driveway is not paved. Otherwise, nice neighborhood. Dead end street with playground for children. This property is on the quiet end of the street directly across from the playground, corner lot. Looks like a good investment. We will need to track this person down.

Once the homeowner is found the pitch would be straight to the sale of the property to our company. There is little need to go through the rest of the options with this homeowner. It would simply be straight to the sale of the property. Again, this particular note tells us that he had it on the market for 249,000 dollars for two years or so. So we could easily tell him that the price of the property is too high and substitute it for the price that we would sell the property at. (see your manager or the index for the price). Next, I would use the Homeowner chart again to go through the price we could offer on the house and why. Once you as a locator get familiar with the costs associated with a home you can forego using the chart.

This vacant property purchase should be fairly easy once we have tracked down the homeowner. There is no emotional attachment, in fact the homeowner should be relieved to get rid of the property. I would stay on your manager to find these owners and provide you with the means to make a deal.

JUST OUT OF BANKRUPTCY OR IN BANKRUPTCY BUT IS LIQUIDATING THE PROPERTY TO PAY FOR THE PLAN.

What assumptions can we make if the home just came out of bankruptcy?

1) We know that they are finished with most of the options. They can file bankruptcy again but it will not help them.
2) The Homeowners can try to refinance but the cost of the mortgage will be astronomical.
3) That the homeowner has tried everything to save the home and failed.

Here the homeowners have been through the entire process. They have borrowed money from friends and relative, tried to restructure, and refinance the home as well as save it in bankruptcy plan by forcing a payment plan on the bank. Nothing has worked. You need to allow the homeowner a way out with dignity if possible. That may come from you just purchasing the property and giving them enough to begin renting.

They only have two real options left: 1) sell on the open market or sell to us. Your job is to explain to them the problem of selling on the open market with only weeks to go to the auction is not a viable option. The real option is trying to get some equity out by selling to us.

This type of purchase has to be performed with surgical precision. You have homeowners who are emotionally drained from the process of trying to save the home. They trust nobody including the lawyer who took them into bankruptcy and feel like everyone has screwed them. If you are empathetic now would be the time to show it.

Here is a note on a property where this happened.
7/31 note: Relief from stay of auction granted.
11/05 note: In chapter 13 now. He isn't interested in hearing our option as the thought of selling his home makes him cringe. He did agree with me that selling is better than losing to auction. He has the auction stayed for some time now. Let?s keep an eye on his bankruptcy. This is a good home.

From the note the locator has been watching this house since early November 2005. Long time to check in on the property, but it is getting ready to payoff. The new note indicates that the bank has now received the right to foreclose upon the property. It is usually the step before the bankruptcy being dismissed.

The locator will now need to go out to the home and listen to the story of the bankruptcy and convince this homeowner that it is best to sell the home instead of losing it to the bank. This homeowner really does not want to sell the house in fact he would rather stay in the house. With that in mind it is going to be a tough sell.

Again, this pitch should be a straight up number crunching pitch going through the items on the chart. Remember you are going to have to deal with the emotional tie to this house. From the note it is quite evident that this particular homeowner has this tie. When I make the pitch I usually talk about the house as sticks and bricks which is not really a home. The home is his family and the memories which they get to bring with them to the new house they will be occupying. If you can get through the emotional you will purchase the house.

China's Incredible Real Property Appreciation

Readers who routinely follow my articles on Real Estate Economics are fully aware of my position on real estate bubbles in North America.

A real estate bubble occurs when prices of real capital assets become so absurdly high that consumers either refuse or cannot afford to purchase, thus sending demand tumbling down. This has not happened in North America's real estate markets, where we have assisted at either a slowdown in property appreciation or a depreciation of values in line with the Fed's forecast of late 2005 and the beginning of the year, as well as with those of many economic analysts - including myself. This is the reason why this time around I wanted to give an example of a true real estate bubble.

As reported by the official Xinhua News Agency, there is a growing concern among top officials of the People's Republic of China that surging prices in major cities threaten to create economic overheating and serious social unrest. This has prompted a new crackdown by the Chinese leadership on property speculation. The National Development and Reform Commission (NDRC), the state planning agency, in fact reports that in North-eastern Dalian in the first three months of this year prices for new properties jumped 15 percent from a year earlier, and that prices in the Southern boomtown of Shenzhen gained 10 percent in the same period. While in Beijing, says the NDRC, prices were up 17 percent amid euphoria over the forthcoming 2008 Olympics in the Chinese capital.

But before you hop on to the first flight for Beijing, read this. Chinese economists say that owning an apartment is now an unrealistic dream for large numbers of urban residents who are falling further behind as home prices surge. The core of the problem appears to be the disparity between prices of real capital assets and wages. More specifically, the average apartment in the city costs 13 times the annual average salary.

Now, that's what I call a real estate bubble!

The main reason for this huge levitation of prices is speculation. Speculation is one of the many forces that act on capital at any given time. In theoretical Economics, speculation is defined as ?the acquisition of financial or capital assets made solely to quickly profit from fluctuations in their prices, or of goods or commodities with no real intent to consume or otherwise use them for production'. Basically what many Chinese speculators are doing is flipping apartments, even before they are built. NDRC reports that many developers have gone even as far as creating independent companies that they themselves control, the sole purpose of which is to buy the apartments the developers are in the process of building and then resell them with a markup, thus inflating prices.

Property is a big driver of Chinese economic growth, and runaway investment in the real estate sector has contributed to signs of a broader overheating. The economy grew by a red-hot 10.2 percent (annualized) in the first quarter of the year from a year earlier, when it grew to the tune of 8 percent per year. Concern about too-rapid growth has prompted the government to raise bank lending rates by 0.27 percentage points last month to discourage borrowing and reduce investment. Officials fear that overheating could lead to a sudden economic crash. Additional measures are in the wings, including hefty increases in property taxes, again to take aim at property developers who hoard land and buildings, a practice that creates artificial shortages and drives up prices

Scarier still is the social unrest that the leadership fears if the economy does not slow down to more manageable levels. This is due to a growing imbalance of wealth rampant in China's population of 1.3 billion people, wherein thirty-five percent of the population lives in the cities and sixty-five percent inhabits the countryside. There is a system of residence controls, so that if one is lucky enough to be born in a city - and registered as a city dweller - it is easier to get into university or to work at all the large companies and government agencies in the city. If, conversely, one is registered as a rural person there are very severe restrictions on where he can live and work. And this is actually the biggest human rights problem in China today. The majority of this population of 1.3 billion people consists, by law, of second-class citizens who live for the most part in conditions of abject poverty, in rural huts many of which do not even have running water. One can imagine how these people feel when they look at the way their urban counterparts live.

The economic ripples and effects that a speculation in grand style such as this have on market wealth are indeed humongous. Market wealth is defined as ?the combination of materials, labour, land, services and technology in such a way as to capture a profit' (Adam Smith). The aftershocks of a bubble of this size that bursts are usually terminal and irreversible: market wealth disappears, it vanishes entirely. And it takes forever to re-build it, right from scratch. Here in the West, the greatest example in recent times is the infamous Black Monday - October 19, 1987 - when the Dow Jones collapsed 22.6 percent in value in a single day! It took nine years for Wall Street to lure investors back.

But then, how much is too much? Well, consider this: at the top end of the market, even the smallest apartment in a building next to Citigroup's skyscraper on Shanghai's waterfront is stunningly expensive. Complete with all-copper doors and Swarovski crystal lights it costs about USD 2 million or USD 1,670 per square foot - and no fireplace.

Flipping and Capital Gains

A common dilemma for real estate investors is the issue of flipping and taxes. In this article, we look specifically at the tax issues associated with flipping and capital gains.

In recent years, people have been looking at the real estate market as they once looked at the stock market, eyes filled with dollar signs. Flipping became a popular real estate investment strategy to make fast cash. However, one thing that people forgot in their haste to play the game was to be properly prepared with the knowledge to avoid paying high taxes on their profits. Towards that end, here's some noteworthy information about taxes as you think about your flipping strategy.

First, in order to avoid overly onerous "ordinary income taxes" on flipping properties you must have the property treated as a capital gain. Most often, if you sell the property in less than a year, you will be taxed at the ordinary income tax rate, which can be in excess of 35 %. Only when you've held the property for more than a year, does the long-term capital gains tax of 15 % (for most tax payers) come into play. In order to have the property treated as a capital gain you must show that you had no intention of flipping that property. Ironically, this could entail holding the property for this extended period of time which counteracts the whole point of flipping - which is to make money fast.

Also, it's not only about "when" you flip, but about "how often" you flip. If you flip too often, the IRS may view that this strategy is your "trade or business" and therefore the profits you make are subject to ordinary income and self-employment taxes. And you don't want that.

Secondly, if you want to employ other strategies to avoid big taxes like installment or structured sales or private annuity treatment while flipping, you can't. Spreading tax out doesn't work because the property is not labeled investment property. This again goes back to issue of holding periods and intention of sale.

If you are hoping to use the 1031 exchange strategy as the approach for flipping and capital gains, again you will find yourself between a rock and a hard place. 1031 exchanges are reserved for investment properties only and if you can prove, through holding periods and intention, that the property is a capital gain or investment property, you will not be eligible. The IRS supports investors and savers, not speculators and gamblers.

Once most of your tax deferral options are exhausted, your last resort for flipping and capital gains may be to have that property re-characterized to a capital gain property by moving in to it and treating it as your personal residence. It may work, but holding even longer holding periods apply.

In conclusion, flipping can be an exciting and fast way to make money. But when it comes to taxes it is hard to make flipping and capital gains work together.

States That Do Not Recognize 1031 Tax Exchange

This article looks at states that do not recognize 1031 tax exchange. While Section 1031 is part of the United States Internal Revenue Code (IRC), it is important to know whether the same rules apply to State taxation for those states that have income taxes. Some states simply follow the rules of the IRC, while others have completely separate set.

While IRS Section 1031 allows any US investment or business real property to be replaced tax free with any other investment or business real property anywhere in the United States, there are states that do not recognize 1031 tax exchange. These states only allow an exemption from State taxation if the replacement property is located in that same state. If the proceeds are reinvested into property located outside of that particular state, it will be considered a taxable event and state income tax will be payable.

Besides costing investors the State taxes, this will also require them to keep track of a separate higher cost basis for the replacement property for State tax purposes than is to be used for Federal taxes.

Currently, it is our understanding that the only two states that do not recognize 1031 tax exchange (Georgia and Mississippi) will only honor the tax free status of a 1031 exchange if the replacement property is also located within their borders. Rules do change, so double check with the State tax authorities.

For the other states that do recognize a 1031 exchange, and do allow capital gains that had accrued on their properties to be rolled over into other states, they will expect the deferred taxes to be paid if and when the replacement property is disposed of in a taxable event. But in practical terms, this hardly ever happens because honestly, most times investors aren't telling, and more importantly, states aren't actively pursuing that information. Still, you would hate to be made the test example.

Finally, some states also have different rules, including special tax withholding requirements, applying to sellers of in-state properties who are not residents of those states. The list includes California, New York, and Maryland.

In summary, to ensure a smooth exchange, it is important to be aware of those states that do not recognize 1031 tax exchange. Also, it is critical to review the specific rules of the states in which both relinquished and replacement properties are located well before a deal is scheduled to close. This will ensure consistency with particular state rules including that the proper amount of taxes are withheld from the exchange, if necessary.

Property Renovations: Part 2 More Focus Areas

In Part One of our discussion, we focused on several aspects of home renovation that are important for success in your investment. Last time, we focused on more of the smaller details - the garden, repairing and touching-up minor damages, fences, etc. Now, we should focus on some of the more noticeable areas of property renovations.

It?s very important to check for any electrical or plumbing problems before you start doing any painting on the interior of the home. This way, you won?t run into any problems down the road with re-painting if any damage occurs.

Painting your interior is important stuff - you?d be surprised at the degree that paint affects the selling price. The key is to do your math first; if you feel like painting yourself would save enough money and could be in done in an adequate amount of time, you should use the do-it-yourself approach. However, if you are inexperienced and are unable to devote enough time and effort into the project, letting a professional do the job is probably the safest route.

When approaching the paint job, keep in mind the K.I.S.S. principle: Keep It Simple, Stupid! Don?t let your personal preferences affect the way you go about your property renovations. The following are some basic painting rules you should follow:

1. Always prepare surfaces prior to painting. Be sure to wash down walls, and repair any cracks or holes, and sand, where needed. Bathrooms and kitchens are the most susceptible to grime and mold, so pay close attention.

2. Use one color. It saves you time and money. Gloss paint usually appears darker, providing slight contrast. The condition of the trims should determine the use of gloss or semi-gloss. Remember, as well, that gloss tends to highlight imperfections.

3. Make a trip to the paint store and browse the newest colors. Feature walls are an effective way to add some pizzazz to your paint job. Dark, small rooms and dark paint do not mix; this only enhances the problem.

4. If there are darker colors or wall stains, you should use a special sealer. If you don?t, and you apply extra coats of paint, the walls will remain stained.

5. Wallpaper trims often add a nice touch, so apply when needed.

The kitchen, for many homeowners, is the center of attention. Kitchen remodeling, however, can get pricey, so you may want to stick to changing minor features on the property. Renovations such as new bench tops, repainted cabinet doors, and new wall tiles are all simple fixes. New door handles, faucets, and wallpaper trims are all low-cost solutions, as well.

Sometimes a quick facelift isn?t enough. On some occasions, a kitchen may need to be fully replaced. If this happens, remember the K.I.S.S. approach, and don?t go overboard. Many suppliers offer kitchen kits which are ready to assemble; these can help save loads of time if you come across them. Keep the kitchen light and bright, with cheerful curtains.

Make sure all appliances are in working order, and only replace if it is unavoidable. Install a durable floor, and test all faucets, to ensure that water pressure is adequate. If you run across second-hand items in good condition, make use of them.

An Introduction To Inspection

An inspection is a formal examination or evaluation exercise. It normally involves measurements, gauges and tests to determine whether the characteristics of the object or activity being inspected confirm to pre-decided standards.

Inspections are usually not destructive; rather, inspection is required at all levels in society to ensure that most ordinances are enforced as fairly and efficiently as possible, thus ensuring safety and security for everyone. Automobiles, buildings and homes may be inspected for this purpose. One could also have inspections at various stages of purchase, like pre-purchase and post-purchase of products or when refurnishing one?s home. Thinking of Buying a Condo Hotel? Here Are 20 Things You Need to Know!

1. What is a condo hotel or condotel?
Think of a condo hotel (also sometimes called a condotel or hotel condo) as buying a condominium, although one that is part of a four-star caliber hotel. Therefore, as an owner, when you are on vacation, you?ll get the benefit of more four-star services and amenities than you'd get in a typical condominium.

2. What types of services and amenities are found in condo hotels?
If you can imagine the niceties you?d find in an upscale hotel, then you can picture a condo hotel. Among the features are often resort-style pools, full-service spas, state-of-the-art fitness centers, fine dining restaurants, concierge services and room service.

In some locations, like Las Vegas, you?ll find condo hotels with their own casinos, retail areas, and entertainment venues. In places like Orlando, you?ll find condo hotels with their own water parks and convention facilities.

3. What is the difference between a condo hotel and a traditional condominium?

Disadvantages include:

? The condo hotel unit is subject to the same dips in the market that affect all hotels in the competitive market set: hurricanes, terrorist threats, warm winters up north, price of gas, etc., all of which can affect a unit's occupancy rate and the amount of revenue it generates.

11. Are condo hotel units difficult to finance?
Not at all, but they do take 20% down typically, whereas condos can be purchased with less cash down. It's also important to make sure you use a mortgage broker who has had success in getting condo hotel financing deals done. Many banks still do not do them, but more and more are getting involved as condo hotels become more widely available.

12. How long have condo hotels been around and where are they located?
Condo hotels have been around for several decades, but the huge surge of four-star and five-star condo hotels that have been making their way across the country, started around year 2000 in the Miami area. The Miami-Fort Lauderdale area still has the most condo hotels, but areas like Orlando and Las Vegas are developing condo hotel properties at an even faster rate and will likely surpass South Florida soon. Other up-and-coming areas are places like the Bahamas, Panama, Dominican Republic, Mexico, Canada and Dubai.

13. How much do condo hotel units cost?
That?s like asking how much a car costs. There are different quality condo hotels. Some require greater amounts of money than others, obviously.

There are inexpensive condo hotels out there for as little as $100,000. These are typically found in properties that have converted their use from an existing hotel. They are hotel room-sized, lack kitchen facilities, luxury franchises, and other first-class amenities.

Then there are the four-star or greater properties that may start in the $300,000 to $400,000 range, but can go all the way up to $800,000 just for a studio unit. One- and two-bedroom units cost substantially more than a studio. Of course, the studios do come fully furnished and finished, and will be significantly larger in size than a typical hotel room, and may attract guests because of its name like St. Regis, Ritz or W.

14. What are typical maintenance costs?
On average about $1.00 to $1.50 per sq. ft., but the range can exceed $2.00 sq. ft. in the most luxurious properties.

15. Do you buy condo hotel units after they have been built, or can you purchase condo hotels in pre-construction?
Unless you are in a hurry to get started vacationing or you need to complete a 1031 exchange, it's best to buy condo hotels in pre-construction as early as possible. That?s when prices are lowest and unit selection is greatest. You will likely wait two years or longer before closing on and taking possession of your condo hotel unit, but you will have locked in the price and will get the benefit of maximum appreciation.

16. Is there anything else investors should want to know about condotels?
There is more to buying this type of real estate than the old phrase, location, location, location. While most condo hotels are located in desirable resort and business area locations, what is most important is a good franchise with a strong reservation system.

Also, do not be fooled by an aggressive rental split. One way or the other, the developer of the property will have to staff, maintain and operate the hotel and its services like the restaurants, bars, spas and pools from his share of the proceeds. If he's giving you a very favorable share of the rental, he's also more likely to be charging you a higher monthly maintenance fee. Of course, this goes both ways. If the maintenance split that is offered is closer to 50-50, then your maintenance should be more reasonable too.

17. Any suggestions to investors in choosing which condo hotel to buy?
Get good advice. That means you don?t want to rely only on the pitch provided by an onsite salesperson at a condo hotel. You want to talk with a broker who specializes in condo hotels and who knows and understands the entire condo hotel market, not just the facts pertaining to a single property. He or she will listen to your wants and needs and then offer recommendations as to which properties best match your requirements. You?ll have an opportunity to comparison shop and consider the pros and cons of each available property.

A good broker can be the difference between your buying a condo hotel that will be problematic and not live up to your expectations or one that will provide you with years of great vacations, good annual revenue and a substantial profit when you sell.

18. Does it cost more to use a real estate broker to purchase a condo hotel than buying a unit on one?s own?
No. With new condo hotel properties, the prices are always set by the developer and are exactly the same whether you buy directly from an onsite salesperson at the property or using a broker.

The broker?s commission is always paid by the developer and is already built into the price regardless of whether an outside broker participates in the sale or not. Since a broker?s representation is free to buyers, it does make sense to enlist their aid and get the benefit of their advice before making a purchase.

19. How can prospective buyers find a good condo hotel broker?
Ask friends for broker recommendations or search online for ?condo hotel broker.? Visit condo hotel broker websites and see if the information they provide seems comprehensive and unbiased. If their website seems to focus on selling homes or office space, and the condo hotel information appears to be an afterthought, steer clear. Agent Marketing Minute: Let a Brag Book Tell Your Story

In today's competitive real estate marketplace, I still amazed at how few agents know how to communicate their real estate business story to a home buyer and seller. First impressions count, and you need to be prepared verbally and visually to tell your story and why the consumer should use you and not the competition. Soon after I started in the business I developed for lack of a better name, my brag book, that take on all listing appointments and first meetings with buyers.

My books' contents are always evolving and are constantly updated with current information and examples. The first section has as many active, pending, and closed listings as I can fit in. I include property brochures, postcards and virtual tours on CD-ROMs. Include a variety of price points and locations.

The second section has examples of newspaper advertisements, magazine features, and screen prints from my and my brokers web site to illustrate what types of marketing I do for a specific property.

Third in my brag book are the actual cards, letters, and emails that have testimonials from clients, both buyers and sellers, about their satisfaction with my real estate business.

Housing Starts Fall 2.5%

The building of new homes has fallen to the lowest level in nearly two years, according to the Commerce Department on Wednesday.

Housing starts fell 2.5% for July to 1.8 million on a seasonally adjusted annual basis. This marks the fifth decline in housing starts in the last six months. It is also the lowest level seen in construction of new homes since November 2004.

Economists had expected a decline, just not as large as today's report indicated.

Building permits fell drastically in July, by 6.5% to 1.75 million units. This is the largest drop seen since September of 1999. Building permits are an indication of future construction activity. Permits are at the lowest level since August 2002.

The Commerce Department also revised June's housing starts downwards, to an annualized rate of 1.84 million, down from 1.85 million.

When compared to one year ago, housing starts are down 13.3% for July.

The confidence of US home builders has continued to fall, according to the National Association of Home Builders. At 32, confidence is at the lowest level since 1991.

Economists agree that the housing market is changing. The debate continues as to the size of the decline and the potential impact to the economy.

Home Staging Can Help You Sell Your House Quickly

Real estate prices have hit record levels in the United States during the last five years. In some parts of the country, prices have tripled. For those selling houses in the first half of the decade, business was very good, indeed. Rising interest rates and sticker shock have slowed the market down, however. In some parts of the country that used to be hot, sales have slowed to a crawl. In those markets, people who want to sell houses are now waiting months when homes used to sell in days or weeks. What can a homeowner who wishes to sell as quickly as possible do to accelerate the process?

A relatively new service called home staging may be the answer. Staging a home essentially means setting it up so that it makes its best possible presentation to the market. Professional home stagers will, for a fee, come to your house, examine your property, and make recommendations as to what you might do in order to make the house as sale-friendly as possible. In some cases, they will simply recommend a coat of paint, a bit of landscaping, or some new drapes. In other cases, more dramatic help may be needed.

Rates for subsequent months tend to be lower than for the initial month, but many homes that have been professionally staged aren?t on the market much longer than a month. In fact, studies have shown that staged homes often sell in half of the time of other comparable properties.

Having your home professionally decorated in order to sell it isn?t something that everyone needs to do. But in markets with slowing real estate sales, staging a home may be the difference between selling the house this week and selling it three months from now. For many sellers, the investment is more than worthwhile.

Making the Fresh Start Presentation

So you are out and running your route and have found a homeowner home who wants to listen to a Fresh Start Presentation (FSP). Remember the Fresh Start Presentation is the Homeowner Options slide show that you have. It goes through the advantages and disadvantages of the seven (7) options available to the financially distressed homeowner. They are as follows:
1)Sell on the Open Market
2)Refinance the home
3)Restructure the mortgage
4)File bankruptcy
5)Borrow from friends and family
6)Let it go to foreclosure
7)Sell to an investor

Whether you have scheduled an appointment or have just knocked the door the opportunity to make the presentation will lead to money for you. So what is the best way to make the presentation? Do you start with the overview and then go through each option? Do you ask some preliminary questions and get to the homeowners present position or do you just get to the price we will pay for the home and leave it at that?

The answer depends upon the homeowner and your preparation for your visit with the homeowner. Remember ?Information is power and the key to a successful negotiation and purchase of your next home or investment property?. So if you have failed to prepare for your meeting with the homeowner your chances of success are diminished. We try to gather information for you and put it in the notes. Some information can be gathered by going over the pricing of the home when you have a scheduled appointment. The rest of the information will come from the homeowners? needs and wants and honest eyes.

What follows are typical situations you will run into in the field and what assumptions you should make if you run into these types of situations. They are 1) Research indicates that the home is on the market. 2) Home is vacant; 3) Homeowner just came out of Bankruptcy.

Home on the Market

What assumptions can we make if the home is placed on the market?
1) We know that they are willing to leave the home and move on with their lives.

2) The Homeowners have cut the emotional attachment to the home.
3) They have either eliminated or exhausted the following options: refinance, restructure and borrowing from friends and relatives.
From this we can make the following conclusion: The homeowner is left with the bankruptcy option and selling on the open market or to us. Here is a note from a locator regarding a house that is on the market.

Visited 8/12/06; 1PM. Met HO in driveway. HO's are divorced and selling the property. Home vacant. Property is listed with Briarwood Realty. Presented the Fresh Start Program to HO's. Interior of the home is broom swept condition already. Good condition. Husband was ready to give release, wife not willing to give release today. Wife indicated that she would like to take a few days and to talk with the bank on Monday. We agreed to contact each other on Tuesday 8/15/06. I left contact info with them and received their contact info as well. Will take complete set of photos when I get the release. Both HO's confirm that they have equity in the property.

Now what part of the FSP would you pitch to get the release? How do you begin the process? If I knew the number they had placed on the house, I would talk about market time, home inspections and the possibility of an unsavory investor tying them up until it is too late and purchasing at the auction. If I did not know the market number I would ask for the price and how long it has been sitting on the market. This type of presentation should begin with a back-up plan or safety net plan. It should inform the homeowners that we could possibly purchase the property in a quick fashion and net them some money for their fresh start. We would do this by making a deal with the listing broker to continue to list the property after we purchased it. Saving the homeowners the cost of the broker. We could also inform them that they would not have the carrying costs, insurance, taxes, and foreclosure costs that are currently stacking up on the property. All of this may add up to a less stressful conveyance than waiting out a slow market. If you are fairly new at locating just use the making the offer to the homeowner chart to walk you through the offer: This chart is located on the resource page of the website.

When a home is on the market it is fairly difficult to get a homeowner to agree to sell the property to an investor. Reasons are that some mortgage broker has told them that they can sell their home for a number we will not pay. Only time and an auction date will usually make this homeowner come around. A smart locator will make the pitch for the backup plan and wait until it is close to the auction to return for a final opportunity to purchase the property. In the meantime just call the homeowner every week or ten days to check in on their situation. This will allow you to have a continuing dialogue and build some type of relationship with the homeowner.

HOME IS VACANT

What assumptions can we make if the home is vacant?

1) We know that they are willing to leave the home and move on with their lives (they already have).
2) The Homeowners have cut the emotional attachment to the home.
3) That the house is costing the homeowner carrying costs each and every day. We can stop the bleeding by purchasing the home.
4) Homeowner should be happy to unload the property.

Here is a note of a recent vacant home visit:

Visited 8/12/06; 3:15PM. HO not home. Left into letter in the door with personal note. Spoke with the neighbor to get an update on this property. Mailbox is full. Shrubs and vines have overgrown the yard and cover the primary entrance to the house. Lawn has not been mowed in months. Neighbor says that the owner is a great person. He seems to think that the owner has another residence in Marshfield. This property had been up for sale. The HO has been trying to sell it for almost 2 years. He believes that the last listing was $249K. He also has been in the house and said that a lot of work has been done on the inside. Driveway is not paved. Otherwise, nice neighborhood. Dead end street with playground for children. This property is on the quiet end of the street directly across from the playground, corner lot. Looks like a good investment. We will need to track this person down.

Once the homeowner is found the pitch would be straight to the sale of the property to our company. There is little need to go through the rest of the options with this homeowner. It would simply be straight to the sale of the property. Again, this particular note tells us that he had it on the market for 249,000 dollars for two years or so. So we could easily tell him that the price of the property is too high and substitute it for the price that we would sell the property at. (see your manager or the index for the price). Next, I would use the Homeowner chart again to go through the price we could offer on the house and why. Once you as a locator get familiar with the costs associated with a home you can forego using the chart.

This vacant property purchase should be fairly easy once we have tracked down the homeowner. There is no emotional attachment, in fact the homeowner should be relieved to get rid of the property. I would stay on your manager to find these owners and provide you with the means to make a deal.

JUST OUT OF BANKRUPTCY OR IN BANKRUPTCY BUT IS LIQUIDATING THE PROPERTY TO PAY FOR THE PLAN.

What assumptions can we make if the home just came out of bankruptcy?

1) We know that they are finished with most of the options. They can file bankruptcy again but it will not help them.
2) The Homeowners can try to refinance but the cost of the mortgage will be astronomical.
3) That the homeowner has tried everything to save the home and failed.

Here the homeowners have been through the entire process. They have borrowed money from friends and relative, tried to restructure, and refinance the home as well as save it in bankruptcy plan by forcing a payment plan on the bank. Nothing has worked. You need to allow the homeowner a way out with dignity if possible. That may come from you just purchasing the property and giving them enough to begin renting.

They only have two real options left: 1) sell on the open market or sell to us. Your job is to explain to them the problem of selling on the open market with only weeks to go to the auction is not a viable option. The real option is trying to get some equity out by selling to us.

This type of purchase has to be performed with surgical precision. You have homeowners who are emotionally drained from the process of trying to save the home. They trust nobody including the lawyer who took them into bankruptcy and feel like everyone has screwed them. If you are empathetic now would be the time to show it.

11/05 note: In chapter 13 now. He isn't interested in hearing our option as the thought of selling his home makes him cringe. He did agree with me that selling is better than losing to auction. He has the auction stayed for some time now. Let?s keep an eye on his bankruptcy. This is a good home.

From the note the locator has been watching this house since early November 2005. Long time to check in on the property, but it is getting ready to payoff. The new note indicates that the bank has now received the right to foreclose upon the property. It is usually the step before the bankruptcy being dismissed.

The locator will now need to go out to the home and listen to the story of the bankruptcy and convince this homeowner that it is best to sell the home instead of losing it to the bank. This homeowner really does not want to sell the house in fact he would rather stay in the house. With that in mind it is going to be a tough sell.

Again, this pitch should be a straight up number crunching pitch going through the items on the chart. Remember you are going to have to deal with the emotional tie to this house. From the note it is quite evident that this particular homeowner has this tie. When I make the pitch I usually talk about the house as sticks and bricks which is not really a home. The home is his family and the memories which they get to bring with them to the new house they will be occupying. If you can get through the emotional you will purchase the house.

PERSISTENCE WINS AGAIN

Do you know the story of Sisyphus? He was eternally condemned by the Greek Gods to push a rock from the underworld to the top of a mountain. Once he reached the mountaintop he watches as the stone rushes down the mountainside in a few moments back to the underworld. Sisyphus is then forced to walk back to the underworld and repeat this endeavor for eternity. An endless, mindless futile and hopeless labor with no chance of success.

Like Sisyphus our locators ceaselessly drive to a house to try to contact the homeowner only to have no contact. Homeowner was not home. Hiding in the house etc. It seems that the locator has been condemned by the managers to ceaselessly drive to the property leave a personal note and try again. Futile labor with no reward.

A locator could give up and stop running a property-nobody would blame the locator-we know it is a tough job requiring persistence and hard work. So here is our latest story of persistence with a reward.

This property came into the system on March 27, 2006-almost five months ago! (That is double the time a Massachusetts property usually stays in the system). The locator saw the property in April, May, June, without ever talking to the homeowner. Just taking a picture, leaving a note and waiting for a call back. Finally on July 13, 2006 the locator caught the homeowner at the door-the homeowner acknowledged receiving the letters and agreed to an appointment for Saturday on July 16, 2006.

The locator drove to the house for the appointment only to receive a note indicating that he could not meet today and requesting the locator to call on Monday. The locator set up a second appointment and the homeowner simply did not show up for the appointment. The locator had a telephone call to the homeowner and he could hear the homeowner state that he could not talk at the moment.

August rolled around and the locator went back to the house and met a friend of the homeowner and learned that the wife of the homeowner was very sick and was slowly recovering. Finally on August 14, 2006, the homeowner called to schedule an appointment. The locator went to the appointment and went through the FSP and secured the release. Here are the notes on the property. April 9 : nice hood no one home left paper work follow up with a visit May 7: went to the prop. and they were hiding in the home refuse to answer May 16: went to the prop. no one home send letter and follow up with visit June 10: went to the prop. no one home send letter and follow up with a visit they have three dogs June 17: Visited 6/17/06 - Not Home. Left letter requesting they call to set up an appt. June 30: went to the prop. they were home didn?t answer the door send letter and follow up with a visit no pics i thought i already had them sorry next time July 13: Visited 7/13/06; 6:30PM. Met HO, Paul, at the door. He acknowledged receiving the letters of intro that have left at the door. Said that he was heading out and asked if I could come by Saturday at 3PM. Set appt. for Sat, 7/15/06, 3PM July 15: Visited 7/15/06; 3PM. HO not home. HO left a note at the door indicating he could not meet with me today. Requested that I call his cell on Monday to schedule appt. for next week. July 18: Visited 7/18/06; 7:30PM. This was a scheduled appt. with HO. HO was not home. Waited until 8PM. Left letter at the door requesting call back to reschedule. July 25 : Tele-con at 9AM; 7/25/06. This is the second Tele-con since my last visit. Both times the HO (Paul) was in the background and instructed the person I was speaking with to tell me that he was unavailable at this time. How close is this situation to auction? August 5: Visited 8/5/06; 10:45AM. HO not home. Left letter with info to contact for appt. Spoke with Paul's friend that was at the house. Learned that the wife is still in rehab. Recovering from poisoning due to a burst abscess on her spinal cord. She has been down for 3MO. Slowly recovering. August 14: Paul called late last week message was lost now found August 17: property has a market value in pristine condition of 260k. i have put in the rehab budget of 16,500 allowing us to purchase right around 163k plus or minus last sale of houses on your way are at 1654 and 1737 Washington we should shoot pictures of those properties to show the differences for pricing August 17: Visited 8/17/06; 6PM. Presented Fresh Start Program; secured release, faxed to Admin 7:40PM. Property is in good condition. Overall, this is a big house. HO is ready to sell. HO would like to get as much of the equity as possible in order to create a fund for the two girls that he and Nancy have. The story is a sad one. He, Paul, is terminally ill with double lung cancer and diabetes. His doctors would like to remove his left foot but he is resisting. He has been given 6 - 9 more months to live. He told me that he has lost 60 lbs in the past 3 months and he can tell that his breathing is becoming a problem. His wife, Nancy, was being treated for a pinched nerve. In reality, a cyst had formed around her spinal cord and exploded destroying her spinal cord. She is now a quadriplegic and will never be able to return to the home. If she is release from the rehab facility, she will be cared for be her oldest daughter; hence, the fund. This property is ready to be purchased. I mentioned to Paul that there are a lot of options to think about and that we would get back to him by Wednesday with a status update and possibly a proposal by the end of the week.

Relocating to San Diego

Congratulations on your new job and on relocating to San Diego. Your company probably has a generous package of relocation benefits for you, and has given you a list of approved San Diego real estate agents and mortgage lenders to use. Generally this list is not thoroughly examined for the qualifications of all the agents in the San Diego area. These are usually not the best agents and they won?t save you time or make the move smoother.

Many companies seek to reduce relocating expenses by receiving referral fees from San Diego real estate agents and mortgage lenders. Those San Diego real estate agents on the ?approved? list are not so much qualified as they are willing to give back some of their fee to your company. That is why your company might say your relocation benefits are in jeopardy if you don't use the approved San Diego agents.

Not all of the agents on the list are incompetent, but they aren?t necessarily all certified however. You should never let your company assign an agent to you. Stop Dreaming and Sell Your House Now

Any home will sell, given enough time. How much time do you have?

One of the most frustrating things about selling a home, condo, townhouse during a slow market is trying to price it so that it sells in the amount of time the owner wants to sell it in.

You don?t want price your property so high that it doesn?t sell.

Of course you don?t want to price it so low that you unknowingly give money away to your buyer.

This is a fine line that a property seller ends up walking.

Here is what I suggest a home seller do to find the best sales price for their home given the amount of time that they have to sell:

?Get Three CMA?s:

Call three real estate agents that have at least two years of real estate sales experience. Tell them you are thinking of selling your property and want to get a CMA (CMA: Comparative Market Analysis). A CMA will be a written estimate of the value of your property based on recently sold properties that are similar to yours. Be sure and let the agents know that you are talking to other real estate agents.

Between the three values you should be able to get a fairly good idea of what your home might sell for.

Heads Up:
There may be other homes in your neighbor that are for sale. Don?t confuse their asking prices for actual home values. Home sellers can ask any price for their home. Values are figured strictly by what similar homes have sold for.

Heads Up:
It is fairly likely that one of the agents may have set the CMA value considerably higher than the other two. This may be due to negligence on their part, but it is more likely that they are ?buying the listing?. They set the CMA price high in an effort to get you to list with them. Later they will pressure you to lower your price to where it should have been in the first place. Of course by now they have wasted your time while you waited for your over-priced home to sell. I have seen this over and over again. This is a common ploy. Don?t get taken by this deception.

?How long will it take to sell?

When you have figured out what seems to be a good asking price for your home, you will have a good idea which agent you would like to use to help get your home sold.

Ask your agent how long other homes like yours have taken to sell. Let?s imagine that the average ?days on the market? (Days on the market: number of days a home takes to sell after it is put up for sale) is 120 days. If you are not in a hurry this may sound just right to you.

What if you need or want to sell faster than our 120 day example? Let?s say you have a new job that starts in 90 days in a new city. It usually takes 30 days to ?close the sale? (close the sale: sign the final documents transferring title to the buyer), after your home ?goes under contract? (goes under contract: you have a buyer that wants to buy, has signed a sales contract with you, and is in the process of getting a loan). You realize that you need to find your buyer in no more than 60 days after you put it up for sale.

You are going to have to ask your agent to give you an idea of where to price your home so that it sells (goes under contract) in 90 days. Hopefully they can come up with a fairly good idea of the 90 day sales price.

What I might do, if I were your agent, is to figure out what the highest selling price you could ask, so that you could sell your home in one day. Then figure out the seven days selling price, a 30 days selling price, and then a 90 days selling price.

For example:

?Let?s say the 120 day sales price for your home is $275,000.

?Then given one day to sell your home, you might be able to get $200,000 (30% below market value).

?Given a week you could probably sell your home for $225,000 (20% below market value).

?30 days sales price: $240,000 (15% below market).

?And finally, 60 days sales price: $255,000 (8% below market value).

?Priced at $255,000, your home will look like a bargain to a home buyer, and you are more likely to get a faster sale.

In a slow market you have to be willing to lower your asking price, maybe more than once in order to get your home sold in a timely manner. Be prepared mentally for this possibility and your home selling process will be smoother and faster.

How High Did Home Prices Really Go

The U.S. Census Bureau released data on Tuesday that revealed where the nation's hottest markets were during the past five years.

According to the report, median home values increased 32% from 2000 to 2005 on a national level. The survey looked at 7,000 markets with a population of 65,000 or more.

San Diego saw the highest price gains. The median home value after being adjusted for inflation increased by 127% from $249,000 to $567,000 in five years.

Of the 15 largest cities surveyed, Los Angeles came in second, with a median home-value increase of 110%. New York City came in third, with an increase of 79%.

Boynton Beach, Florida, was the top market among the 15 smallest cities surveyed. After inflation adjustments, the median home-value increased by 120%. Folsom, California, came in second where the home value increased by 100%, while Redondo Beach, California, saw a 92% gain and a third place ranking.

Just about anyone who owns a home or has been in the market for one in the past few years knows first-hand how home values jumped from 2000 to 2005, said Census Bureau Director Louis Kincannon in a written statement.

In addition to the value of the home rising, the monthly cost of owning a home also increased during the first half of this decade, according to the survey. The median monthly cost, which includes mortgage payment and other costs, saw a 5% increase after adjustments for inflation.

In Detroit, the cost increased by 24%. Chicago experienced a 22% increase, while San Francisco came in third among the largest cities with an increase of 20%.

Among the smallest cities, Bryan, Texas, and Greenville, N.C., saw cost decreases of 10%.

The cost of renting a home has also increased over the past five years. Nationally, the cost to rent has increased by 6.7%. San Diego saw the largest increase of 27%.

Real median rent cost decreased in a few large cities. San Jose saw a decrease of 9%, while Dallas saw a decrease of 3%.

July Foreclosure Activity Increases

There was an 18% year-on-year increase in July foreclosure filings, according to RealtyTrac. The month saw 92,845 filings.

That is one new foreclosure filing for every 1,245 households.

While foreclosure activity continues to remain slightly below historical averages, there looks to be a significant amount of upward pressure on foreclosure rates in the next few months, siad James J. Saccacio, chief executive officer of RealtyTrac.

First, the billions of dollars in ARMs projected to reset in the third and fourth quarters could increase monthly mortgage payments for many homeowners, Saccacio explained. And the cooling real estate market exacerbates the problem for these homeowners by making it tougher for them to sell at a high enough price to pay off their loan balance.

Colorado had the highest rate of foreclosures in the country, with a new foreclosure filing for every 480 households. The state has had the highest foreclosure rate for five straight months.

Colorado saw an increase of 3% in foreclosure filings for the month, and a 55% increase for the year. The state reported 3,810 households entering some form of foreclosure.

Nevada had the second highest foreclosure rate for the second month in a row. There was one new foreclosure filed for every 533 households. There was a 31% increase in foreclosures for the month with 1,626 households entering some stage of foreclosure.

Texas led the country in the most foreclosures with 12,103 filings. The state has remained in this position for eight consecutive months. There was a 15% increase in foreclosures when compared to June.

Six states, including Texas, Florida, California, Michigan, Ohio and Illinois, represented 54% of the nation's foreclosure activity in the past month.
